Dallas Police fight for 'blood draws' for suspected DWI charges

The Dallas Police Department has been holding ‘No Refusal’ Weekends for holiday weekends where heavy drinking is suspected, but police now want this to be the main evidence in all DWI charges.

During a ‘no refusal’ weekend a person that is pulled over for suspicion of drunk driving has a choice to breath into a breathalyzer and if they say no, and there is probable cause, a nurse can draw their blood.

Police want blood testing to be the primary evidence in DWI cases because they feel that they are more accurate and because a blood samples allow police to test for more than alcohol, like illegal drugs. There is controversy over this mandatory testing because some feel it violates people right and is unreasonable search and seizure.
