Court finds father of children killed in DUI crash not guilty of shooting

A Texas jury found David Barajas not guilty of shooting Jose Banda on Wednesday, August 27, a report from CNN affiliate KHOU showed. Barajas and his two young sons, 12-year-old David and 11-year-old Caleb, were pushing their truck, which had run out of gas, along a road near Houston when they were hit by a drunk driver, identified as Jose Banda. The two young boys were killed. A few moments after the crash, Banda was found shot to death near the accident site.

Barajas’ defense attorney, Sam Cammack, cast reasonable doubt in the minds of the jury members that it may not have been Barajas who shot Banda, for there had been DNA evidence that there was another person in Banda’s car at the time of the accident.
